Terms of Service

1. Acceptance of Terms

By accessing and using Eastern Europe Properties ("the Platform", "we", "our", or "us"), owned and operated by Binary Trust SRL, a company registered in Romania, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

These Terms apply to all users of the Platform, including but not limited to property seekers, agencies, and content contributors.

2. Description of Service

Eastern Europe Properties is a property aggregation and listing platform that:

• Aggregates property listings from various sources across Eastern Europe
• Provides AI-powered property analysis and insights
• Connects property seekers with agencies and property owners
• Offers tools for agencies to list and manage properties
• Facilitates communication between parties

We act as a platform connecting buyers/renters with sellers/landlords. We are not a real estate agency and do not represent either party in any transaction.

3. User Accounts

3.1 Account Registration

To access certain features, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate.

4. Agency Accounts and Listings

4.1 Agency Verification

Agencies must undergo verification before being marked as "Verified" on the Platform. Verification includes:

• Business registration verification
• Contact information confirmation
• Domain ownership verification
• License verification (where applicable)

4.2 Property Listings

Agencies listing properties agree to:

• Provide accurate and truthful information about all properties
• Have the legal right to list the properties
• Update listings promptly when properties become unavailable
• Respond to inquiries in a timely and professional manner
• Not post duplicate listings
• Comply with all applicable local, national, and international laws

4.3 Subscription Plans

Agency subscription plans are subject to the pricing and terms outlined on our Pricing page. Subscriptions automatically renew unless canceled. Refunds are provided according to our refund policy.

5. Prohibited Activities

You agree not to:

• Post false, misleading, or fraudulent listings
• Impersonate any person or entity
• Use automated systems (bots, scrapers) without permission
• Harvest or collect user information without consent
• Transmit spam, viruses, or malicious code
• Interfere with the proper functioning of the Platform
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or threaten other users
• Bypass security measures or access restrictions

6. Intellectual Property

6.1 Platform Content

All content on the Platform, including text, graphics, logos, images, software, and AI-generated analysis, is owned by Eastern Europe Properties or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

By posting content (property listings, photos, descriptions), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content on the Platform and in marketing materials.

You represent that you own or have the necessary rights to all content you post.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Platform will be uninterrupted, secure, or error-free
• Property information is accurate, complete, or current
• AI-generated analysis and scores are accurate or reliable
• Any property will meet your expectations or requirements
• Agencies or property owners are trustworthy or reliable

You use the Platform at your own risk. We strongly recommend conducting your own due diligence before entering into any property transaction.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASTERN EUROPE PROPERTIES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from property transactions or disputes
• Actions or omissions of agencies, property owners, or other users
• Inaccurate property information or AI analysis
• Unauthorized access to or alteration of your data

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim, or €100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Eastern Europe Properties, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on the Platform
• Property transactions you engage in through the Platform

10. Third-Party Services and Links

The Platform may contain links to third-party websites (property sources, booking platforms, etc.) and integrate with third-party services (payment processors, analytics). We are not responsible for:

• The content, accuracy, or practices of third-party websites
• Third-party terms of service or privacy policies
• Transactions conducted on third-party platforms

11. Payment Terms

11.1 Agency Subscriptions

Agency subscription fees are charged monthly or annually as selected. All fees are in Euros (EUR) and exclude applicable taxes.

11.2 Refunds

Subscription fees are non-refundable except:

• Service outages exceeding 48 consecutive hours
• Material breach of these Terms by us
• Within 14 days of initial subscription (one-time only)

11.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for early cancellation.

12. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Requests by law enforcement
• Extended periods of inactivity
• Technical or security reasons

Upon termination, your right to use the Platform ceases immediately. We may delete your account and content without liability.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

15.2 Arbitration

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Bucharest, Romania, except for:

• Claims related to intellectual property infringement
• Small claims court actions
• Injunctive relief requests

15.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class arbitrations.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eastern Europe Properties.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
